Abstract: This researches deals with the manner and procedure of peaceful labor disputes resolution (collective and individual ones), with special reference to the way of dealing with the labor arbitration as a form of the most democratic labor disputes resolution .The main source of peaceful resolution of individual and collective labor disputes is Law on peaceful labor disputes resolution adopted in 2004. but some parts of it are regulated by Labor law adopted in 2014. Concerning that we are in a time of transition and economic instability business companies are I enable to fulfill obligations to employees which cause turbulence inside of them. Due to low supply of jobs on the market high unemployment put employees in position in which they allow disrespect of their guaranteed rights, and not to be treated with respect. These reasons lead to a conflict between the individual and the collective labor relationship. Resolution of these conflicts is better suited by peaceful means rather than in ordinary court proceedings.

Apstrakt: Rad se bavi mirnim rešavanjem radnih sporova, sa posebnim osvrtom na arbitražno rešavanje radnih sporova, kao jedan od najdemokratskijih metoda rešavanja sporova. Kada je reč o mirnom rešavanju radnih sporova osnovni izvor je Zakon o mirnom rešavanju radnih sporova, koji je donet 2004. godine, mada neke delove uređuje i Zakon o radu, koji je donet 2014 godine. Obzirom da se nalazimo u vremenu tranzicije i ekonomske nestabilnosti, što povlači za sobom turbulencije u privrednim društvima i izaziva njihovu nemogućnost ispunjavanja obaveza prema zaposlenima. Takođe, velika ne zaposlenost, a mala ponuda radnih mesta na tržištu rada, dovodi zapolene u situaciju, da dozvoljavaju nepoštovanje njihovih zagarantovanih prava, od strane poslodavaca. Iz svih ovih razloga i još mnogih drugih dolazi do konflikata između subjekata individualnog i kolektivnog radnog odnosa. Rešavanje tih konflikata je mnogo pogodnije mirnim putem, nego u redovnom sudskom postupku.
