Abstract: The usual practice of representatives of executive authorities in Serbia to announce arrests, to “bid up” about the outcome of the trial, and even to violate the presumption of innocence, significantly undermines the integrity and independence of the judiciary. Such a situation contributes to the creation of an impression of the lack of independence of the judiciary due to the executive power. European standards of judicial independence recognize the special protection of the judiciary as well as judges in the context of freedom of expression, while stressing that the judiciary should not, nor it does function in a legal and factual vacuum, since some issues of the administration of justice belong to a legitimate subject of public debate. In the light of the current reform of the judiciary in Serbia, and in the focus of achieving European standards of independence of the judiciary, paper will analyze the culture of (non) compliance with the limits of freedom of expression in pursuing the independence of the judiciary. The aim of the paper is to demonstrate the extent to which the culture of respect for freedom of expression in Serbia can contribute to the achievement of the independence of the judiciary, especially within the negotiating chapters for EU accession.

Apstrakt: Uobičajena praksa predstavnika izvršne vlasti u R. Srbiji da se najavljuju hapšenja, da se „licitira“ o ishodima suđenja, pa čak i da se krši pretpostavka nevinosti, značajno dovodi u pitanje integritet i nezavisnost pravosuđa. Takvo stanje doprinosi stvaranju utiska zavisnosti pravosuđa od izvršne vlasti. Evropski standardi nezavisnosti pravosuđa priznaju posebnu zaštitu pravosuđa, kao i nosioca pravosudnih funkcija, u kontekstu slobode izražavanja, istovremeno ističući da pravosuđe ne sme, niti može, funkcionisati u pravnom i faktičkom vakuumu, budući da pojedina pitanja sprovođenja pravde spadaju u legitiman predmet javne debate. U svetlu aktuelne reforme pravosuđa u R. Srbiji, a u fokusu postizanja evropskih standarda nezavisnosti pravosuđa, u radu će se analizirati kultura (ne) poštovanja granica slobode izražavanja u funkciji postizanja nezavisnosti pravosuđa. Cilj rada je da pokaže u kojoj meri kultura poštovanja slobode izražavanja u R. Srbiji može da doprinese ostvarenju nezavisnosti pravosuđa, posebno u okvirima pregovaračkih poglavlja za pristupanje EU.
