Apstrakt: Tranzicioni period i prelazak na tržišni način privređivanja sa sobom je doneo i niz novina sa kojima su se po prvi put susreli, kako vlasnici kapitala (svojinska transformacija i tržišni način privređivanja), tako i vlasnici radne snage, odnosno zaposleni. Stalnost i stabilnost zaposlenja, kao i sva ostala pravom zagarantovana prava zaposlenih, su dospela u drugi plan zbog čestih promena procesa rada, usled tehnološkog napretka, te slabljenja položaja i pregovaračke moći sindikata, zatim usled eventualno lošeg poslovanja privrednog subjekta i sl. Otuda i drastično povećanje broja privrednih subjekata nad kojima je pokrenut stečajni postupak, pa samim tim i svih pravnih posledica koje on sa sobom povlači. Te posledice nisu samo pravno – ekonomske, već i sociološke, obzirom na to da svim zaposlenima u takvom privrednom subjektu u momentu pokretanja stečajnog postupka, prestaje radni odnos i oni od tog trenutka postaju poverioci svog nekadašnjeg poslodavca za sva eventualno zaostala potraživanja na koja imaju pravo po osnovu radnog odnosa, sa jedne strane, a sa druge ostaju bez posla i bez osnovnih egzistencionalnih sredstava za život. Opšte je poznata činjenica da su zaposleni uvek ekonomski slabija ugovorna strana, te da je radno zakonodavstvo i nastalo kao potreba da se prava zaposlenih imperativno zaštite intervencijom države u obligacioni odnos između poslodavca i zaposlenih. Zbog svega navedenog, zaposleni nikako ne smeju biti tretirani na isti način kao i ostali stečajni poverioci, već se njihova prava u slučaju stečaja poslodavca moraju osigurati dodatnim mehanizmima. Dakle, koja prava zaposlenom stoje na raspolaganju ukoliko se nad njegovim poslodavcem pokrene stečaj? Da li je to regulisano institutima privrednog ili radnog prava ili je ovo jedan od samo nekoliko slučajeva zajedničkog delovanja?

Abstract: The transition period and crossing to the market economy have brought a series of novelty which met for the first time, owners of capital (ownership transformation and market economy), as well as the owners of the labor force or employees. The permanence and stability of employment, as well as all other rights guaranteed for the employees, have come to the forefront due to frequent changes in the work process, due to technological progress, and the weakening of the position and negotiating power of the trade unions, then due to the eventual poor business decisions. That is why there is a drastic increase in the number of companies in bankruptcy proceedings, and with all legal consequences that it entails. These consequences are not only legal and economic, but also sociological, since all employees in such a companies at the moment of the initiation of bankruptcy proceedings cease their employment and from that moment they become creditors of their former employer for all possible arrears to which they are entitled on the basis of employment, on the one hand, but on the other they are left without work and without basic existential means of living. It is generally known that employees are always economically weaker, and that labor legislation has emerged as a need for the rights of employees to be imperatively protected by state intervention in the obligatory relationship between employer and employees. Due to all of these, employees must not be treated in the same way as other bankruptcy creditors, but their rights in the event of bankruptcy of the employer must be ensured by additional mechanisms. So, which rights are available to employee if bankruptcy is initiated against his employer? Is this regulated by institutes of commercial or labor law or is this one of only a few cases of joint action?
