Types of compensation for non-material damages caused by workplace injuries or by occupational disease of employee
Oblici naknade nematerijalne štete zbog povrede na radu ili profesionalne boleseti radnika
Apstrakt: Sa stanovišta naknade štete i prava iz socijalnog osiguranja profesionalna bolest ima dosta zajedničkog sa povredom na radu. One imaju slične ili identične posljedice, njihove žrtve imaju jednaku pravnu zaštitu, a pravno su relevantne samo onda kada su nastale na radu ili u vezi sa radom. Obeštećenje oboljelih radnika od profesionalne bolesti zasniva se na istim principima na kojima se zasniva zaštita povrijeđenih na radu. U ovom radu posebna pažnja je posvećena vidovima naknade nematerijalne štete koji se javljaju usljed povrede na radu ili profesionalne bolseti radnika.
Abstract: When we talk about compensation of damages and social insurance rights, occupational disease has a lot in common with workplace injuries. They have similar or even identical consequences, the victims have equal legal rights, and are only legally relevant when they occur at work or in work related situations. Compensation for employees suffering from occupational disease is based on the same principles as the protection of workplace injured employees is. In this paper, special attention is dedicated to the types of compensation for non-material damages which occur due to workplace injuries or occupational diseases of employees.
