The role of the council of europe in creating legal instruments related to artificial intelligence

Sažetak: Svedoci smo da se na utvrđivanju pravne regulative u oblasti veštačke inteligencije intenzivno radi i to kako na nacionalnim, tako i na međunarodnom novou. Autori se u radu bave delatnošću Saveta Evrope u ovoj oblasti, koja je usmerena na kreiranju i usvajanju Evropske konvencije o veštačkoj inteligenciji. Nakon uvodnih razmatranja i analize do sada preduzetih koraka, posebno se fokusiraju na dokument Ad hoc Komiteta Saveta Evrope za veštačku inteligenciju - Mogući elementi pravnog okvira o veštačkoj inteligenciji, zasnovanog na standardima Saveta Evrope o ljudskim pravima, demokratiji i vladavini prava. U zaključnim razmatranjima ukazuju na potrebe i moguće pravce daljeg pravnog regulisanja ove oblasti.
Summary: Intensive work on establishing legal instruments in the field of artificial intelligence is ongoing, both nationally and internationally. The authors deal with the activities of the Council of Europe in this area, which is aimed at creating and adopting the European Convention on Artificial Intelligence. After introductory reviews and analysis of the steps taken so far, special focus is on the document of the Ad hoc Committee on Artificial Intelligence of the Council of Europe - Possible elements of a legal framework on artificial intelligence, based on the Council of Europe’s standards on human rights, democracy and the rule of law. The needs and possible directions of further legal regulation of this area are pointed out in the conclusion.
