Apstrakt: Radi lakšeg usklađivanja porodičnih obaveza i zaposlenja i potpunije zaštite deteta u novoj porodičnoj sredini, radno pravo omogućuje posebnu zaštitu licu kome je, po propisima o usvojenju, upućeno dete na prilagođavanje i usvojiocu. Posebna zaštita lica kome je, po propisima o usvojenju, upućeno dete na prilagođavanje je različita od posebne zaštite roditelja; ono nema pravni položaj roditelja, već učesnika u postupku usvojenja i, u cilju bržeg i uspešnijeg prilagođavanja detetu, a deteta novoj porodičnoj sredini, ima pravo na odsustvo sa rada. Usvojilac ima pravni položaj roditelja i uživa posebnu zaštitu koja je istovetna sa posebnom zaštitom roditelja. U tom smislu ima pravo na odsustvo sa rada radi (posebne) nege deteta, pravo na zaštitu zaposlenja i pravo na zaštitu u okviru instituta radnog vremena.

Abstract: For the sake of easier reconciliation of family obligations and employment and more complete protection of the child in the new family environment, labor law provides special protection to the person to whom, according to the regulations on adoption, the child has been sent for adjustment and the adoptive parent. The special protection of the person to whom, according to the regulations on adoption, the child has been referred for adaptation is different from the special protection of the parents; it does not have the legal status of a parent, but rather a participant in the adoption procedure and, in order to more quickly and successfully adapt to the child, and the child to the new family environment, has the right to leave from work. The adoptive parent has the legal status of a parent and enjoys special protection that is identical to the special protection of parents. In this sense, he has the right to leave from work for (special) child care, the right to employment protection and the right to protection within the working time institute.
