Mirno rešavanje radnih sporova – iskustva Srbije, Bugarske i Sjedinjenih Američkih Država
Peaceful settlement of labor disputes – experiences of Serbia, Bulgaria, and the United States
Abstract: The purpose of this paper is to present the methods of institutional resolution of labor disputes in three different countries, Serbia, Bulgaria, and the United States. What connects all three countries in the field of peaceful resolution of labor disputes is that all three have institutions for resolving labor disputes. However, these institutions differ in their methods of work, organization, practices, and formal legal jurisdiction. In the paper, we will provide an overview of these institutions for peaceful resolution of labor disputes, analyze and describe the way these institutions are organized, as well as describe their practice and contribution in the field of institutional extrajudicial procedures for peaceful resolution of labor disputes. Also, a special segment of the paper will be dedicated to the practice of the Republic Agency for Peaceful Settlement of Labor Disputes in Serbia, presenting its practice along with an analysis of case studies of individual and collective labor disputes resolved through arbitration and mediation methods.
Apstrakt: Svrha ovog rada je da se predstave načini institucionalnog rešavanja radnih sporova u tri različite države, Srbiji, Bugarskoj i Sjedinjenim Američkim Državama. Ono što povezuje sve tri države u oblasti mirnog rešavanja radnih sporova je sve tri države imaju institucije u kojima se rešavaju radni sporovi. Međutim, te institucije se međusobno razlikuju po načinu rada, organizaciji, praksi kao i formalno-pravnoj nadležnosti. U radu ćemo napraviti prikaz na ove institucije za mirno rešavanju radnih sporova, analizirati i opisati način organizovanja ovih institucija, kao i opisati njihovu praksu i doprinos u oblasti institucionalnog vansudskog postupaka mirnog rešavanja radnih sporova. Takođe, poseban segment rada ćemo posvetiti praksi Republičke agencije za mirno rešavanje radnih sporova u Sribiji, prikazati njenu praksu uz analizu studija slučajeva individualnih i kolektivnih radnih sporova koji su rešavani metodama arbitraže i mirenja.
