Protection of consumer rights in the tourist industry of Serbia

Резиме: Предмет овог рада је заштита потрошача у туристичкој привреди Републике Србије. Рад објашњава генералну улогу заштите потрошача у туризму, као специфичној делатности. Полазећи од најчешћих кршења права туриста у Србији, представљају се основне одредбе најважнијих позитивно-правних норми и организациона и институционална решења у области заштите потрошача у туризму Србије. У складу са потребом прилагођавања опште правне регулативе Србије у процесу приступања Европској унији, у раду je укратко представљена правна регулатива у истој области у Хрватској, као земљи из региона која је у поступку пријема у Европску унији, као и општa правнa регулативa саме Европске уније. Дат је осврт и на посебну врсту заштите права потрошача – кривично-правну заштиту, уз напомену да су ту потребне законодавне интервенције ради прецизније инкриминације и заштите потрошача у туризму. Инсистира се на већој стручности и оспособљености инспекцијских органа у области туризма, као и њиховој бољој координацији. Легислатива у овој области не недостаје, ради се о томе да се она почне примењивати у пуном обиму.

Summary: This paper is focused on the protection of consumer rights in the tourist industry of the Republic of Serbia. An explanation is given of the general role of consumer rights protection in tourism as a specific form of business. Starting from most typical tourist rights violations perpetrated in Serbia, we review basic regulations of principal legal norms and organizational and institutional solutions provided in the field of consumer rights protection in the tourist industry of Serbia. In view of the impending need to harmonize the general legislation of Serbia with that enforced in the European Union (EU), the paper provides brief outlines of the corresponding legislature in Croatia, as a country from the same region which had entered the procedure of joining the EU, and the general legislation of the EU itself. A special type of consumer rights protection – criminal law protection – is reviewed, making note that legislation amendments are needed in order to establish a more precise incrimination procedure and improve the consumer rights protection. A necessity to improve the professional adeptness and coordination between tourist inspection offices is highlighted. The field of tourist industry is adequately covered from the legislative point, it is the question of fully enforcing the available legislature.
