Norms and mechanisms of fulfilling the rights to accessible medical protection in the Republic of Serbia

Резиме: Полазећи од значаја омогућавања доступности здравствене службе као услова остварења квалитетне здравствене заштите, те индикатора који указују да је из корпуса права пацијената право на доступност здравствене заштите на врху листе најчешће угрожених, аутори кроз критички приказ нормативних, институционалних и функционалних механизама заштите, желе да изнађу кључне разлоге оваквог стања. Препознајући најчешће појавне облике повреда права, као централни предмет анализе узет је посебни законски институт којим је уређен начин и поступак остваривања права на најбројније здравствене услуге, а чије кључно обележје представља изричито утврђен рок у којем се исте морају пружити. Оно што додатно отежава задатак аутора јесте постојање супсидијарног метода остваривања истих права, који представља корективни елемент и нормирану екстензију домашаја права на здравствену заштиту, на начин да иста и даље задовољава законски оквир оличен у одредби „у границама материјалних могућности система здравствене заштите“ као јединог реалног ограничења рада здравственог система. Постојање овако квалитетног и целовитог модела, али и свести о свакодневним проблемима грађана да закажу и обаве лекарски преглед, представљају посебан изазов у изналажењу целисходних решења. Ово је истовремено разлог и основни мотив да адекватни одговори буду препознати у позитивноправном систему здравствене заштите, имајући на уму да до сада спроведене реформе система заштите права пацијената нису дале задовољавајуће резултате.

Summary: Considering the importance of warranting the accessible health service as a condition of fulfilling the high-quality medical care, as well as the indicators that signify the frequency of cases where the patients’ rights to accessible health care are endangered, the authors seek to locate the key reasons for the current status through the critical account of normative, institutional and functional mechanisms of protection. By recognizing the most commonly manifested infringements of rights, the central point of analysis is represented by the specified legal norm that regulates the means and procedures of fulfilling the right to the most common health services, whose key feature lies in the explicitly stated final date that the aforementioned services must be provided until. The authors’ goals are additionally hindered by the presence of the subsidiary method of fulfilling these rights, which represents a corrective element and a normative extension of the right to health care and its capacity, in terms of its continuous fulfillment of the legal framework summed up in the article “within the limits of the material possibilities of the health care system” as the only realistic limitation of the health care system’s functionality. The existence of such a high-quality and comprehensive model - as well as the awareness of the patients’ common problems in scheduling and having their doctor’s appointments - presents a particular challenge in finding the most effective solutions. Concurrently, this is the reason and the essential motive for recognizing the adequate answers in the positive-law health care system, being aware of the generally unsatisfying results of the previously implemented patients’ rights protection system reforms.
