Civil lawsuit and enviromental protection in the Republic of Serbia and in some countries of Southeastern Europe

Summary: The need for environmental protection is increasingly present in all spheres of society. The laws regulating environmental protection are adopted, they adopt various international agreements and conventions, all in the light of sustainable development. The paper will discuss the civil protection of the environment and the possibilities of filing a lawsuit in civil proceedings. In Art. 156. The ZOO of the Republic of Serbia is the normed right to prevent and remove any source of danger from which significant damage is threatened. However, although the claim itself is disputed, the active legitimacy of the parties, as well as just proving the merits of the claim, there are tendencies that the law will regulate a special civil procedure in order to protect collective rights in the field of environmental protection. Also, the normative and comparative methodology will also present the current solutions in terms of civil protection of the environment in the countries of South-East Europe.
Сажетак: Потреба за заштитом животне средине је све више присутна у свим сферама друштва. Доносе се закони којима се уређује заштита животне средине, усвајају разни међународни споразуми и конвенције, а све у светлу одрживог развоја. У раду ће се говорити о грађанскоправној заштити животне средине и могућности подношења тужбе у парничном поступку. У чл. 156. ЗОО Републике Србије је нормирано право да се спречи и уклони било какав извор опасности од кога прети знатнија штета. Међутим, иако је споран сам тужбени захтев, активна легитимација странака, као и само доказивање основаности тужбеног захтева, постоје тенденције да се законом нормира посебни парнични поступак ради заштите колективних права у погледу заштите животне средине. Такође ће се, нормативним и компаративним метододом приказати и актуелна решења у погледу грађанскоправне заштите животне средине у земљама југоисточне Европе.
