Set-off and credit bidding in the bankruptcy proceedings

Сажетак: У раду су приказане законске одредбе, ставови судске праксе, као и мишљења правне науке, о пребијању потраживања у стечајном поступку. Важећи Закон о стечају из 2009. године уводи нови концепт законски дозвољеног и ограниченог пребијања. Претходни Закон о стечајном поступку из 2004. године није регулисао ову материју, а недостатак специфичне регулативе у том периоду довео је до развоја судске праксе. Закон о принудном поравнању стечају и ликвидацији из 1989. године применио је принцип обавезног пребијања. Аутор се бавио правним аспектима пребијања. Нарочита пажња посвећена је посебним законским условима за остваривање права на пребијање потраживања у стечајном поступку. Анализирана су и правила парничног поступка о компензационој противтужби и приговору. Објашњена су нова законска правила која омогућавају полагање цене коришћењем потраживања (credit bidding).
Summary: The paper presents the legal provisions, the views of jurisprudence, as the opinion of the legal science, on the set-off in the insolvency proceedings. Applicable Law on bankruptcy from 2009 introduces the new concept of legally permissible and limited set-off. Previous Act on insolvency procedure from 2004 has not regulated this topic, and lack of specific regulation in that period led to the development of judicial practice. The Law on compulsory reorganization, bankruptcy and liquidation from 1989 applied the principle of obligatory set-off. In this study the author dealt with the legal aspects of set-off. Particular attention was paid to the specific legal requirements for acquiring the right to bail out claims in bankruptcy proceedings. The rules of the civil proceedings for the counter-claim were analyzed. New legal rules that provide credit bidding are explained.
