The status of environmental refugees from the aspect of international legal standards

Sažetak: Tokom poslednjih decenija ekološke i klimatske promene uzrokovale su pojavu nove kategorije izbeglica – ekoloških izbeglica. Cilj rada odnosi se na sagledavanje statusa ekoloških izbeglica u kontekstu standarda ustanovljenih međunarodnopravnim instrumentima. Predmet analize u radu predstavljaju najpre odredbe Konvencije o statusu izbeglica iz 1951. godine i Protokola o statusu izbeglica iz 1967. godine. Posebna pažnja je posvećena i razmatranju položaja ekoloških izbeglica sa aspekta relevantnih međunarodnih propisa u oblasti zaštite životne sredine. U okviru zaključnih razmatranja autori su istakli značaj uspostavljanja međunarodnopravnog okvira regulisanja pitanja statusa ekoloških izbeglica i izneli određene sugestije u cilju jasnijeg definisanja predmetne materije.
Summary: During the last few decades, environmental and climate change has created a new category of refugees - environmental refugees. The aim of this paper is to consider the status of environmental refugees in the context of the standards provided by international legal instruments. First of all, the subject matter of the paper refers to the analysis of the provisions of the Convention Relating to the Status of Refugees (UNCHR, 1951) and of the Protocol Relating to the Status of Refugees (OHCHR, 1967). Special attention is devoted to the examination of the position of environmental refugees in terms of the relevant international regulations in the field of environmental protection. Within the concluding remarks, the authors have emphasized the importance of establishing the international legal framework regulating the issue of the status of environmental refugees and provided certain suggestions in order to define the subject matter in a more precise manner.
