Agency employment
Summary: Agency employment as a way of hiring workers (the so-called labor leasing) has been present on the global labor market, but also with us, for more than ten years. Until recently, the legal status of these agencies in the Republic of Serbia was not regulated, and on December 6, 2019, the Law on Agency Employment was adopted, which was discussed a few years back and whose implementation began on March 1, 2020. Many employers have opted in practice to hire workers in this way, to circumvent the strict and restrictive provisions of the Labor Code. The enactment of this law should, first and foremost, enable the protection of persons employed through agencies, but also contribute to the reduction of undeclared work. The aim of this paper is to analyze the provisions of the new Law governing the field of agency employment, as well as to analyze international regulations, among which the most important is the ILO Convention no. 181 on Private Employment Agencies, and the compliance of the Law on Agency Employment with these regulations. In addition, part of the paper is devoted to comparatively fair presentation of regulations governing temporary agency recruitment.
Sažetak: Agencijsko zapošljavanje kao način angažovanja radnika (tzv. lizing radne snage) prisutno je na globalnom tržištu rada, ali i kod nas, više od deset godina. Pravni status ovih agencija u Republici Srbiji do nedavno nije bio regulisan, a 6. decembra 2019. godine donet je Zakon o agencijskom zapošljavanju, o kom se polemisalo nekoliko godina unazad i čija primena je počela 1. marta 2020. godine. Mnogi poslodavci su se opredeljivali u praksi da angažuju radnike na ovaj način, kako bi zaobišli stroge i restriktivne odredbe Zakona o radu. Donošenje ovog zakona trebalo bi, pre svega, da omogući zaštitu lica koja se zapošljavaju preko agencija, ali i doprinose smanjenju rada „na crno“. Cilj ovog rada je analiza odredbi novog zakona koji reguliše oblast agencijskog zapošljavanja, ali i analiza međunarodnih propisa, među kojima je najvažnija Konvencija Međunarodne organizacije rada br. 181 o privatnim agencijama za zapošljavanje, i usklađenosti Zakona o agencijskom zapošljavanju sa ovim propisima. Pored toga, deo rada je posvećen i uporednopravnom prikazu propisa koji regulišu privremeno agencijsko zapošljavanje.
