Collective rights of national minorities in Serbia

Abstract: The Republic of Serbia is an example of a multiethnic state, characterized by a large number of national communities living on its territory. In addition to guaranteeing full equality and prohibiting violent assimilation, the Constitution of the Republic of Serbia contains a large number of special individual and collective rights of members of national minorities, which are functions of integration, preservation and protection of their identity. The constitutional concept implies the incorporation of the highest international standards in this area. A special quality is represented by collective rights, primarily the right to minority self-government in certain areas, as well as guarantees of their representation in government bodies at all levels. This paper primarily deals with issues related to minority self-government, official use of language and representation in government.
Сажетак: Република Србија представља пример мултиетничке државе, коју карактерише велики број националних заједница које живе на њеној територији. Поред гаранције пуне равноправности и забране насилне асимилације, Устав Републике Србије садржи велики број посебних индивидуалних и колективних права припадника националних мањина, која су функцији интеграције, очувања и заштите њиховог идентитета. Уставни концепт подразумева инкоропрацију највиших међународних стандарда у овој области. Посебан квалитет представљају колективна права, првенствено право на мањинску самоуправу у одређеним областима, као и гаранције њихове заступљености у органима власти на свим нивоима. Овом раду су првенствено обрађена питања која се односе на мањинску самоуправу, службену употребу језика и заступљеност у органима власти.
