Сажетак: Примена интернета и дигиталних технологија је све заступљенија, све већи број правних послова се обавља преко њега, па је нормално да се и развој грађанског права мора кретати у том смеру. До сада, важећи Закон о парничном поступку нормира пет доказних средстава и то увиђај, исправе, сведоке, вештаке и саслушање странака. Долазимо до проблема приликом примене електронских доказа у парничним поступцима пред домаћим судовима, за разлику од све присутније при- мене у европским судовима. Под електронским доказима се сматрају сви докази изведени из података садржаних или произведених од стране било ког дигиталног уређаја, чије функционисање зависи од софтверског програма или података који се чувају или преносе преко рачунарског система или мреже. У овом раду ће се обрадити појам електронских доказа, њихово коришћење и складиштење као и начин примене пред судовима.

Summary: The application of the Internet and digital technologies is more and more represented, an increasing number of legal tasks are performed through it, so it is normal that the development of civil law must move in that direction. So far, the current Law on Civil Procedure regulates five types of evidence, investigation, documents, witnesses, experts and hearing of the parties. We encounter problems when applying electronic evidence in civil proceedings in domestic courts, in contrast to the increasingly present application in European courts. Electronic evidence is all evidence derived from data contained in or produced by any digital device, the operation of which depends on a software program or data stored or transmitted over a computer system or network. This paper will deal with the concept of electronic evidence, their use and storage, as well as the manner of application in the courts.
