Justification of human rights restrictions in the conditions of a pandemic and its border

Summary: Human rights are a legal achievement of the 20th century. We can see their outlines by following the legal-historical thread that starts from the oldest legal monuments. Although there is no talk of human rights in them, nor could the legal consciousness of the time recognize them, the establishment of certain legal principles can be considered a precursor to the idea of human rights. Therefore, it is not immodest to say that the development of human rights is based on previously established legal foundations without which their materialization is not legally feasible or practically possible. The civilizational significance of human rights, as well as their practical scope, are a product of the development of democracy. However, they should not be equated or placed on the same plane. It is easier to state that the development of democracy, including its accompanying contents (political pluralism, independence of the judiciary, efficient public administration, etc.), contributes to the development and affirmation of human rights. That is why on the international and national scene we have a situation in which human rights de jure exist but are de facto too often (un) justifiably limited, nothing or the most gross violations. These are life situations in which the unjustified influence on human rights takes place outside the institute of permissible restrictions. We are witnessing that in the midst of the pandemic, caused by the Covid 19 virus, the question of (mis) use of human rights is openly raised. This is done by two groups of authors: the former accuse entire states of systematic forms of violations of basic human rights, such as the right to liberty, while the latter express the opinion that human rights are justifiably limited so that the scope of their application is not questioned. In light of the above, the author will review the justification of restricting human rights in pandemic conditions.
Сажетак: Људска права представљају правну тековину 20. века. Њихове обрисе можемо уочити пратећи правно-историјску нит која почиње од најстаријих правних споменика. Иако у њима нема говора о људским правима, нити их је тадашња правничка свест могла препознати, установљење одређених правних принципа можемо сматрати претечом идеје о људским правима. Зато није нескромно рећи да се развој људских права заснива на претходно постављеним правним темељима без којих није, правно изводљиво, нити практично могуће њихово опредмећење. Цивилиза- цијски значај људских права, као и њихови практични домети, производ су развоја демократије. Ипак, не треба их поистовећивати или постављати у истој равни. Једноставније је констатовати да развој демократије, укључујући њене пратеће садржаје (политички плурализам, независност судства, ефикасну јавну управу и др.), доприноси развоју и афирмацији људских права. Зато на међународној и националној сцени имамо ситуацију у којима људска права de iure постоје али се de facto пречесто (не)оправдано ограничавају, ниште или пак најгрубље крше. У питању су животне ситуације у којима се неоправдани утицај на људска права одвија изван института дозвољених ограничења. Сведоци смо да се у јеку пандемије, изазване вирусом Covid 19, отворено поставља питање (зло) употребе људских права. То чине две групе аутора: први оптужују читаве државе за систематске облике кршења основних људских права, какво је свакако право на слободу док други износе мишљење да се људска права оправдано ограничавају чиме се домети њихове примене не доводе у питање. У светлу наведеног, ауторка ће преиспитивати оправданост ограничења људских права у пандемијским условима.
