Apstrakt: Digitalna imovina je veoma širok pojam i obuhvata različite oblike imovine koji se mogu javiti u digitalnoj formi. Ono što je zajedničko svim ovim oblicima svojine jeste upravo ta digitalna forma u kojoj se manifestuju. Usled ovakve prirode digitalne imovine, javljaju se i posebne potrebe za preciznijim uređenjem pitanja povodom iste. Tako će se u ovom radu javiti niz pitanja stvarno-pravnog i obligaciono-pravnog karaktera. Razmatranje ovih pitanja nas vodi do srži prirode digitalne imovine. Razvoj novih modernih grana prava će se zasnivati na tome šta će osnovne grane prava reći sa aspekta struke po ovim pitanjima. Danas, ovu oblast krasi nepostojanje jasnog stava zakonodavca, kao i neprecizna upotreba pojmova. To povlači niz problema u poslovanju, ali i u vezi pitanja bezbednosti građana i njihove imovine.

Abstract: Digital property is a very broad term and includes various forms of property that can appear in digital form. What all these forms of property have in common is the digital form in which they appear. Due to this nature of digital property, there are special needs to regulate some issues related to it. Thus, in this work, a few questions of a property law and obligation law character will arise. Consideration of these issues takes us to the heart of the nature of digital assets. The development of new modern branches of law will be based on what the basic branches of law will say from the perspective of the profession on these issues. Today, this area is characterized by the absence of a clear position of the legislator, as well as the imprecise use of terms. This leads to a series of problems in business, but also in connection with the issue of the safety of citizens and their property.
