Review of computer crime in the legislation of the Republic of Serbia

Summary: The development of civilization is accompanied by the emergence of new criminal phenomena, among which the phenomenon of computer crime occupies an important place. Computers and computer technology are misused in various ways, and the higher the level of development of a certain society, the greater the opportunities for the appearance of this type of crime and the existence of the most diverse forms of those crimes. The more diverse and sophisticated the ways of committing the acts are, the more competent, witty and numerous the perpetrators also become. Therefore, we are talking about criminality that is constantly developing, that has a transnational character and that is becoming more and more sophisticated over time. In this sense, it is necessary for the legislator to follow the mentioned tendencies. Accordingly, in this paper, the authors made a brief overview of computer crimes in the legislation of the Republic of Serbia and pointed out certain tendencies that are currently present when it comes to this type of crime, as well as the various possibilities of its manifestation.
Сажетак: Развој цивилизације прати појава нових криминалних феномена међу којима значајно место заузима феномен компјутерског криминалитета. Компјутери и компјутерска технологија се злоупотребљавају на различите начине, а што је виши степен развијености одређеног друштва, веће су могућности за појаву овог вида криминалитета и за постојање најразноврснијих његових облика, разноврснији су и софистициранији начини извршења самих дела, а учиниоци компетентнији, досетљивији и бројнији. Дакле, реч је о криминалитету који је у сталном развоју, који има транснационални карактер и који временом постаје све комплекснији за сузбијање. У том смислу, неопходно је да и законодавац прати наведене тенденције. Сходно томе, аутори су у раду направили краћи осврт на рачунарског криминалитета у законодавству Републике Србије и указали на одређене тенденције које су тренутно присутне када је реч о овом виду криминалитета, као и на различите могућности његовог испољавања.
