Сажетак: Прaво на рад је тековина борбе радничке класе и у свим модерним законодавствима је подигнуто на ниво уставног права сваког човека. Теоретски, сваки човек има једнаку правну позицију код остваривања свог уставног права на рад, али је држава та која омогућава остваривање датог права у пракси, преко своје законодавне активности (запошљавања). Међутим, управо забрињавајуће стање у пракси остваривања права на рад, указује на то да је неки од инструмената који треба да омогуће практично остваривање овог начела, заказао. Дакле, потребно је прецизније одредити садржину самог права на рад, те учинити ефикаснијим механизам који постоји да би се то право могло остварити у пракси. Како је рад повезан са готово свим сферама живо- та савременог човека, у првом реду са образовањем, економском егзистенцијом човека, те личним развојем и напретком појединаца, али и читавог друштва, неопходна је коренита ревизија постојећег друштвено – политичког стања у држави и друштву.
Summary: The right to labor is a legacy of struggle of the working class and in all modern legislation is raised to the level of a constitutional right of every man. Theoretically, every person has the same legal position in exercising his constitutional right to work, but it is the state that allows the realization of the given rights in practice, through its legislative activities (employment). However, situation in practice is worrying , the right to work, indicates that some of the instruments that should enable the practical realization of this principle, failed. Therefore, it is necessary to accurately determine the content of the right to labor and make it more efficient mechanism that exists so that this right can be realized in practice. As the labor is associated with almost all spheres of life of modern man, first of all to education, economic existence of man and the personal development and advancement of individuals, but also the whole society is necessary for a substantial revision of the current socio - political situation in the country and society.
