Сажетак: Условна осуда је кривична санкција која се јавила пре свега као замена за краткотрајне казне затвора, јер је друштво спознало да се сврха кажњавања некада може постићи и само претњом да ће одређена казна бити и извршена. Сврха мера упозорења а самим тим и условне осуде јесте да се без ограничавања права и слобода, учинилац одврати од даљег вршења кривичних дела. Условна осуда је наста- ла као одраз тежње да се казна прилагоди личности учиниоца кривичног дела тако да њено извршење буде одраз потребе за поправљањем делинквента. Међутим, и поред тога што условна осуда представља самосталну кривичну санкцију њена повезаност са казном је неспорна. Сходно томе, аутор ће у раду приказати однос условне осуде и казне, односно указати на повезаност између ових кривичних санкција.

Summary: A suspended sentence is a criminal sanction which occurred primarily as a replacement for short-term prison sentences, because the society recognized that the purpose of punishment can sometimes be achieved only by threat that a particular sentence will be carried out. The purpose of warning measures and therefore the suspended sentence is to deter the offender from further commission of offenses, without any restrictions of rights and liberties. A suspended sentence was formed as a reflection of aspirations to adjust penalty with personality of the offender, so that its execution becomes a reflection of needs to manage offenders. However, despite the fact that suspended sentence represents an independent criminal sanction, its relation to the penalty is highly indisputable. Accordingly, in this paper author will show the relation between the penalty and suspended sentence, and indicate on the connection between these criminal sanctions.
