Summary: Suspended sentence with supervision aims to have an increased impact on the perpetrator during the time of checking. Protective Supervision seeks to replace the main gripe of Franco-Belgian system of a suspended sentence, and that is the absence of any help convict during the checking period. A suspended sentence with protective supervision allows a certain form of treatment at liberty. If a suspended sentence, as a warning measure with a threat of punishment, is a special precautionary measure, which counts on the strengths and abilities of the perpetrator himself, that without help from the side, during the checking period, he leads a regular life, suspended sentence with protective supervision, with regard to its entire content, certainly is more than that. With its obligations and orders, which are imposed on the perpetrator, it also determines the scope of the engagement of the Commissioner for Protection Supervision. It represents a kind of treatment of prisoners at liberty and therefore represents a complete special preventive measure.

Сажетак: Условна осуда са заштитним надзором има за циљ појачан утицај на учиниоца током времена проверавања. Заштитним надзором настоји се надоместити основна замерка француско-белгијском систему условне осуде, а то је одсуство било какве помоћи осуђеном током трајања времена проверавања. Условном осудом са заштитним надзором постиже се одређени вид третмана на слободи. Ако је условна осуда, као мера упозорења уз претњу казном, специјалнопревентивна мера, која рачуна на снаге и могућности самог учиниоца да он без помоћи са стране, током рока проверавања, води уредан живот, условна је осуда са заштитним надзором, с обзиром на целокупни свој садржај, свакако и више од тога. Својим обавезама и налозима, који се намећу учиниоцу, она уједно одређује и обим ангажовања повереника за заштитни надзор. Она представља својеврсни третман осуђеника на слободи и тиме је комплетна специјалнопревентивна мера.
