Abstract: For most institutes of criminal law, the legislator didn’t determe its term. The same is with a suspended sentence. The notion of a conditional sentence is not contained in the Criminal Code. A suspended sentence is a criminal sanction which was originally created under the idea to replace short-term prison sentences. Therefore, it is the alternative criminal sanction which is the substitute for short-term prison sentences. A suspended sentence is a criminal sanction which implies that the offender ordered certain penalty, but at the same time ordered that it not be executed if convicted for a time determined by the court, shows good behavior and perform obligations imposed. Although its main purpose is to replace short-term prison sentences, which is expressly provided for in the Criminal Code and, In theory there is the view according to which the conditional sentence should have been prescribed for the fine too, which will be discussed in the paper.

Сажетак: Као и код већине института кривичног права, законодавац је тако поступио и код условне осуде, не одредивши њен појам. Дакле појам условне осуде није садржан у Кривичном законику. Условна осуда је кривична санкција која је првобитно настала под идејом да замени краткотрајне казне затвора. Дакле, реч је о алтер- нативној кривичној санкцији која представља супститут за краткотрајне казне затвора. Условна осуда је кривична санкција која подразумева утврђивање учиниоцу кривичног дела одређене казне уз истовремено одређивање да се она неће извршити ако осуђени за време које одреди суд, покаже добро понашање и изврши наметнуте обавезе. Иако је њена основна сврха да замени краткотране казне затвора, што је изричито прописано и у Кривичном законику, у теорији је доста присутно становиште по којем би условну осуду требало прописати и за новчану казну, о чему ће више речи бити у самом раду.
