Abstract: The more frequent occurrence of fraud in the field of insurance and their great material and other consequences have caused the need for society's reaction to them. Thus, the incrimination of fraud behavior in the insurance sector has become an integral part of the criminal legislation of a large number of countries. In our criminal law, the criminal act of insurance fraud was introduced by the Law on Changes and Amendments of the Criminal Code from 2009. However, this legal solution was not adequate, and the Law on Changes and Amendments of the Criminal Code from 2016 completely changed the legal formulation of this criminal offense. Insurance fraud is classified into criminal offenses against the economy and includes all fraudulent behavior aimed at collecting insured sums from an insurer. The specificity of these behaviors justifies the imposition of this incrimination, because it would be difficult to fall under the "classical" criminal offense of fraud. The author will point out the specifics and basic features of the crime of insolvency insurance, and then make a review of the most common forms of insurance fraud.

Сажетак: Све учесталија појава превара у области осигурања и њихове велике материјалне и друге последице условиле су потребу реакције друштва на њих. Тако је инкриминација преварног понашања у области осигурања постала саставни део кривичног законодавства великог броја земаља. У наше кривично право је кривично дело преваре у осигурању уведено Законом о изменама и допунама КЗ-а из 2009-те године. Међутим, то законско решење није било адекватно, па је Законом о изменама и допунама КЗ-а из 2016-те године у потпуности промењена законска формулација овог кривичног дела. Превара у осигурању је сврстана у кривична дела против привреде и обухвата сва преварна понашања која имају за циљ наплату осигуране суме од осигуравача. Специфичност тих понашања оправдава увођење ове инкриминације, јер би се тешко могле подвести под већ постојеће кривично дело преваре. Аутор ће у раду указати на специфичности и основна обележја овог кривичног дела, а након тога направити осврт на најучесталије појавне облике превара у осигурању.
