Сажетак: Овај рад има за циљ да укаже на значај patria potestas и круг овлашћења која је ова власт обухватала у периоду пре и за време Римске републике. Patria potestas представља институт својствен римском праву, а обухвата власт оца породице над имовином и лицима која не живе по свом него по праву pater familiasа. Широк је круг овлашћења која је pater familias имао на основу ове власти над лицима alieni iuris. Он не само да је био господар њихове имовине, него и господар њихових живота (ius vitae ac necis) и то је нешто што је несхватљиво са становишта савременог човека који живи у XXI веку, у доба демократије и експанзије људских права. Због тога на рatria potestas треба гледати као реликт из прошлости и одраз друштвених односа карактеристичних искључиво за период трајања Римске империје.

Summary: This paper aims to point out the importance of patria potestas and the range of authorizations that this power encompassed in the period before and during the Roman Republic.. Patria potestas is an institute inherent in Roman law, and includes the authority of the father of the family over property and persons who do not live in their own right but as pater familias. There is a wide range of powers that pater familias had under this authority over alieni iuris persons. Not only was he the master of their property, but also the master of their lives (ius vitae ac necis), and this is something that is incomprehensible from the point of view of a modern man living in the 21st century, in an era of democracy and human rights expansion. Therefore, patria potestas should be seen as a relic of the past and a reflection of social relations characteristic only for the duration of the Roman Empire.
