ABSTRACT: The responsibility of the seller for material shortcomings is a very intere- sting question for every individual, regardless of whether it is a layman or an expert. The importance is enormous since it is a question of life that everyo- ne meets in everyday life and according to statistical data is one of the most frequently asked questions on the Internet. This is an institute that is cha- racteristic of two-pronged bargaining agreements (eg a sales contract). The protection of interests of both the other party, ie the seller and the buyer, as holders and rights and obligations from the obligation relationship, is provi- ded by the Law on Obligations, as well as the Law on Consumer Protection. More detailed and closer analysis of the protection of the interests of the contracting parties, with particular reference to the responsibility of the em- ployer for material defects will be provided in this paper.

REZIME: Odgovornost prodavca za materijalne nedostatke stvari je vrlo interesantno pitanje za svakog pojedinca, bez obzira da li je reč o laiku ili pak stručnom licu. Značaj je ogroman budući da je reč o životnom pitanju s ko- jim se svako susreće u svojoj svakodnevnici i prema statističkim podacima jedno je od najčešćih postavljenih pitanja na internetu.1 Reč je o institutu koji je karakterističan za dvostrano obavezujuće ugovore (npr. ugovor o prodaji). Zaštita interesa kako jedne tako i druge strane, odnosno prodavca i kupca, kao nosilaca i prava i obaveza iz obligacionog odnosa, pružena je Zakonom o obligacionim odnosima, kao i Zakonom o zaštiti potrošača. Detaljnija i bli- ža analiza o zaštiti interesa ugovornih strana, sa naročitim osvrtom na odgo- vornost poslodavca za materijalne nedostatke stvari biće data u ovom radu.
