Živimo u epohi korenitih društveno – političkih promena, koje nastupaju na globalnom međunarodnom nivou. Osnovni problem, koji se ovim radom razmatra jeste odnos vladavine prava u kontekstu tih promena. Poseban problem predstavljaju sve češći ratovi i svetske krize, koje u velikoj meri derogiraju osnovna ljudska prava i narušavaju elementarne postulate vladavine prava. O ovom problemu se ne može govoriti samo u najnovijem periodu, već je do ugrožavanja vladavine prava došlo decenijama unazad. Posebno je evidentno eklatantno kršenje međunarodnog prava i pitanja vladavine prava u međunarodnim odnosima. Cilj rada je da ukaže na krizu prilikom primene vladavine prava i osnovnih načela, da se ukaže na drastično odstupanje od ideje pravde, pravičnosti i moralnosti i da se podstakne potreba za vraćanje ka iskonskim vrednostima, u kontekstu tzv. moralne države i pravičnog prava. Osnovna hipoteza rada je da savremene društveno – političke promene, negativni odnosi, ratovi i primena nasilja otvoreno vode ka narušavanju vladavine prava i principa pravne države. Primenjuju se analitički, istorijski i uporednopravni metod, dok se naučni doprinos ogleda u ukazivanju na eroziju vladavine prava i načela pravne države

We are living in an epoch of radical socio-political changes, which are taking place on a global international level. The main problem, which is discussed in this paper, is the relationship between the rule of law in the context of these changes. A special problem is represented by increasingly frequent wars and world crises, which largely derogate basic human rights and violate the elementary postulates of the rule of law. This problem cannot be discussed only in the most recent period, but the threat to the rule of law has occurred decades ago. A blatant violation of international law and the issue of the rule of law in international relations is particularly evident. The aim of the work is to point out the crisis in the application of the rule of law and basic principles, to point out the drastic deviation from the idea of justice, fairness and morality and to encourage the need to return to the original values, in the context of the so-called moral state and fair law. The basic hypothesis of the work is that contemporary socio-political changes, negative relations, wars and the use of violence openly lead to the violation of the rule of law and the principle of the rule of law. Analytical, historical and comparative law methods are applied, while the scientific contribution is reflected in pointing out the erosion of the rule of law and the principles of the rule of law.
